FAYETTEVILLE - Attorneys for Wal-Mart Stores Inc. filed a federal lawsuit Tuesday against an online company in Pennsylvania, claiming it is using the Bentonville-based retailer's logo to promote its products.
The lawsuit, filed in U.S. District Court in Fayetteville, alleges Direct to Consumer Interactive is using the Wal-Mart logo in email solicitations.
"The prominence of the Wal-Mart name and mark in the subject line of the e-mail offers deceptively lures customers into believing that the e-mail relates to a previous purchase or transaction with Wal-Mart," attorney Asa Hutchinson III wrote in the court filing.
Hutchinson said that Direct to Consumer Interactive is also deceiving people by promising a $500 Wal-Mart shopping card to customers who look at certain promotions.
"In order to be eligible for a `free' $500 gift card from Wal-Mart stores, consumers must sign up for a number of promotions from companies," Hutchinson said.
Wal-Mart has a licensing program for third parties who wish to utilize a shopping card as part of their promotions or marketing efforts.
This agreement restricts how the gift cards can be used.
In November, Wal-Mart attorneys filed a similar lawsuit against a Delaware company. That case is pending in federal court in Fayetteville.

I'd guess this will be settled out of court. CSC will take down the WalMart logo and make a donation to WalMart's favorite charity.

It really could mean anything. Sure it could kill them, but its very possible it'll be settled with no issue to us.
