You can on like ebay or trade it on goozex. It's mostly so retailers can't sale it.

Yeah, it's to prevent retail sale. Private sale is fine.
And no, FOAFY, if your 360 came with games likewise marked, you cannot return them to the store either, because the store can't legally resell them. OTOH if they're packaged and marked identically to retail copies (including the UPC), then you probably can.
