Engadget has tested the following site's software that unlocks iPhones according to Digg.com. I'm sure a lot of you saw it as it's close to 6,000 diggs. If not here's a link

I think some law was passed that specifically said cell phone unlocking IS NOT illegal. I could be mistaken though.

ehh blah shit att was programed to this phone umm your gunna miss out on visual voice mail,you tube, tech support most likely voided warranty no weather no maps or stocks most likely half of the phone is gone when you unlock it why cant ppl just switch and be happy you paid 540 for the phone im guessing you can pay a extra 200 dollars early cancellation fees.

Actually, that's not true. Engadget claims everything works including the YouTube, which does take some type of installation.

I admit, it's not exactly a reliable way to get an iPhone but the features would still all be there until AT&T patches it.

its still not unlock able the website got a call from a law firm which is delaying the release of the site. and possibly shutting down the site apple and att isnt going to give this up without a fight and second engadget must of activate it with att first b/c when ppl bypass the activation their youtube don't work due to when u activate the phone thru apple i think its a akey from Google or sumtin that allows youtube to work. but visual voice is a no no with tmobile

Why would they try to stop it? Apple's sales are going to go through the roof and nobody that already has AT&T is going to pay the $200+ to cancel just to move to t-mobile or something, t-mobile isn't even that good.

Perhaps because they've spent millions working out the details of their exclusivity contract and on marketing the product? The same as all other phone exclusivity contracts that ALL carriers sign with new phones? If they didn't care at all, they would have just released it unlocked.

And I'm sure the legality can be challenged, from at least one of two legal positions

1. DMCA prevents circumvention of any sort of encryption or copy protection. I'm not sure if this applies to the iPhone hardware or not, but if the firmware was in any way protected, for example by a checksum or simple hash to prevent tampering, and that check was bypassed by this hack, then that could most likely be legally construed as circumvention.

2. Virtually all commercial EULA's regarding software, firmware, and even some hardware designs, specifically prohibit reverse engineering or tampering with normal operation in any way. While EULA's are not always enforced without evidence that the violation harmed the first party of the agreement, if it can be shown that unlocking takes revenue away from Apple and AT&T (which it obviously would) by overriding their legally binding exclusivity agreement, then that harm would most likely result in a EULA enforcement.

So yeah, I could see somebody promoting this procedure putting themselves at risk of civil action, if not criminal. And especially if they were selling it, which is probably why the kid who cracked it is insisting that the procedure not be sold.

The thing to remember is that Apple and AT&T have extremely deep pockets, and can easily afford to ruin somebody financially even if that person were to "win" the case. It'll take a helluva lot of balls (not to mention cash) to challenge them in court, if it gets to that point.
