What should I do?

I just recently sold 4 RAZRs for $260 to somebody through eBay, I sent them, and have tracking that shows he got them, but he claimed he didn't, I showed him tracking, then he said the package was empty. He now filed a dispute on paypal and my balance is -$260. I don't even have $260 in my bank account so if I lose I'll get hit with the overdraft fees so I'll be out $300+. Is there any way to stop this? I e-mailed my bank(WaMu) and asked them to block all charges from anything with "paypal" in it, but I'm not sure if they'll do it. I tried removing the account from paypal but that doesn't work either. I'm thinking about closing my WaMu account because of this. Do you think that's what I should do? PayPal always seems to take the side of the scammer, so I'm sure they'll try to get me to pay him. Anybody have advice for me? I really need it. Thanks.

Yes, he was, and I did qualify for it, but stupid USPS kept telling me that address was wrong and I had to use a different one, so I'm not covered. I'll probably just stop by WaMu tomorrow and cancel my account. I shouldn't have a problem just telling them I don't need it anymore and getting a bank check from them, should I?

I would call Paypal and see what they say first before going through the trouble of cancelling your bank account and all that. Its much easier to talk to someone live then waiting for e-mails and such. I'm sure if you have proof of the tracking numbers and what not then you should be fine. Good Luck, I hate scammers like that. I actually ran into some guy the other day who offered me $450 for some phone I am selling and he tried sending me a fake Paypal message that said as soon as I e-mail the tracking number the funds would be deposited into my Paypal account...it mighta worked had this guy not misspelled every other word so I knew he was not actually from Paypal. I just called and reported him.

Does that mean you didn't send it to the confirmed address? If so, bad move. Paypal isn't gong to take your side so yeah, get your money out if you can.

Paypal will probably side with the scammer (they always do..) But your bank probably wont. You may be able to file a charge back.

Well paypal doesn't do that, do they? They just say they can't get the money back. I did send it to the confirmed address, but USPS told me I needed to write it down differently and I sent it to that, I'm not sure if it'll make a difference.

i'm pretty sure that paypal won't take money out of your bank account, they can't legally do that unless u give them permission, they will tell you that you need to do it, but i don't think they can just take it...

i may be completely wrong here, but i remember hearing that before sometime...

Its probably in one of there TOS's somewhere that they can withhold funds from your checking account in the event that you lose a dispute.

actually no, they don't take the money from your bank account

my balance was -$60 once for months and they kept sending me emails to pay them, but they never took it out of my checking account.

I had a checking account and a few credit cards tied to my account and they cannot legally take money out of them unless you agree to it.

they do send a collection agency after you though, so good luck.

Depending on whose name is on the account, two scenarios will occur

1. If his parent's name is on the account, then they will receive collection agency letters. If they do not pay up, then their credit score might [not sure] go down.

2. If his name is on the account, then the collection agency will send letters to him. By chance that he hides it from his parents, he might start receiving phone calls.

Oh alright, it's in my name, but my name is the same as my dad's so they might think it's him. As far as I know Paypal will not withdraw from your account. If a collection agency sends a letter you can still dispute it with them. I believe they give you a month to respond with a letter and explaining your side of the story.

I assume you sent it with confirmation/tracking. I think it tells the weight of the box you send on the white reciept(not the tracking receipt). Anyways, point is that he says it was empty when the box was actually a bit heavy. Also, according to you, he changes his story. Wouldnt that imply that he is lying by saying he never recieved anything then saying the box was empty?

Didn't a PayPal or eBay open a dispute where the you and the buyer submit your evidence and story and then they sort it all out? Also, how different is the address that you used from the one that was PayPal verified?

Well usually when you ship UPS, they measure the weight of the box. If oyu had razor phones in it, then it would obviously weigh more than just a plain old box. YOu can contact UPS and tell them your situation. You can also go to the place where you shipped the box from and they will have your shipment on record.

Then you can provide paypal with all the paperwork from UPS saying that there were items in the box.


Hopefully that helps. Did you insure them? If so then youre covered.

Oh and no, paypal cannot withdrawl from your bank account.

Well if he keeps changing the story, which I'm sure has been on email, wouldn't that help in the dispute console? As long as you kept them all, first the empty one saying it was empty and then the one saying it was a charger, at least I would think

I have 12 phones. I buy them for $30, sell them for $100, buy 2 more, etc., and keep the profit. Nobody likes RAZRs except the people who don't have them, so they'll sell for $30-$40 as a buy it now but people can still get $100+ on eBay.

Did you send him a charger too? If so, you could add the weight of a charger and phone together to sync with the weight of the package. If not, then try checking the difference in weight between a charger and a phone. If you throw that kind of stuff in his face then it will put him on the spot and he'll either have to lie again (changing his story) or fess up.

Also, isn't there a way to track the use of the phone through the phone company or something. I'm not sure so don't hold that against me.

Does paypal know your age?

The thing is, minors are not legally bound by any contracts whatsoever. Selling something on paypal constitutes a contract. In fact, opening a paypal account constitutes a contract. They can't get a single dime from you. When the collections agency calls, just provide them proof of your age and they'll have to drop your case.

Of course, you might not be able to get another paypal account for another 5 years, but...

I honestly don't see how you can lose this case...all the evidence and proof is in your favor. Do not go through the measures of cancelling your bank account and all that mess. The fact that his story has changed more than once should be enough to prove that he is lying about it. Good luck though and definately keep us updated.
