Speeding ticket+reckless driving+court...HELP

i couldnt find the other speeding ticket thread...sorry so link me if you can

i was driving from ocean city maryland to delaware during beach week last night when i got pulled over for wreckless driving for 80 in a 35. my friend who...i was sort of racing but not really got pulled over behind me for 77 in a 35. this is my first time being pulled over and i got tickets for wreckless driving and failure to signal (which i dont even know what thats for).

i didnt know it was a 35 zone....the speed limit earlier on the same road (within 5 mi) was 45 and 55 so that was a drop. i have a mandatory court appearance on june 30th in delaware. i live in maryland about 3 hours away. the cop was a dickhead and called us "motherfucking idiots" or something like that. what can i do? im also 18 and still on the maryland provisional lisensce, will that time period have to restart? and how many points will i get? and how much will the fine be? anything else that you could help me with...thanks.

Don't race like an idiot....That being said I'm sure you have to show up in court (even if it means driving 6 hours total for you -- at least if you don't want to make things worse) and you're probably going to get a hefty fine and a number of points. You might get it yanked for a while on something like that. Good luck to you )

It was 80 in a [bcde6168cdb]35![/bcde6168cdb]. You were over 45 (more than double the limit). They don't take too kindly to that whether your racing or not. Do you have any prior tickets?

Ignorance doesn't change the fact that you were in a 35. Chances are you were driving through a town or area w/ more houses than when it had been 55. It's not uncommon for 55 roads to drop in places where you are likely to have many more pedestrians.

i am sorry but part of your problem is that you are making excuses. even if it was 55 you were still 25 miles per hour over the limit.
this is illegal.
if caught, you get a ticket, or two.
that is called a consequence of your action.
sometimes when we break the law, we have to pay for that broken law.
there is nothing unjust about it, infact it is justice.

that all being said...
do you have a relative who is a lawyer?
sometimes a nice letter explaining that it was your first ticket, you are sorry for your actions as you were caught up in the moment and made a mistake and that you are glad that no one got hurt.

also, NEVER plead guilty for a ticket EVER.
if you cannot appear, you can call the court and change your plea over the phone to guilty in most districts. in NY state that means you actually go down a tier in ticketing.

be glad you are not in NY. a new law was passed last year, and a moving violation of the magnitude of yours would entail a $400 + surcharge on top of any other ticket fine. it sucks.

If you were driving 80 anywhere BUT an expressway, I hope you get nailed with a big ticket. Maybe then you'll learn not to drive with total disregard for everyone else

i lived in md for 28 yrs, it used to be that if you did double the limit or more ( which u did ) it was a loss of your license

I was able to go to traffic school instead of paying a speeding ticket. $79 was worth it since no points went on my record. I didn't have to appear in court.

Your primary concern should be proving that you were NOT going 80MPH. I'd like to stab you for doing 80 in a 35 (which likely means it was a residential area)...but get a lawyer (you should probably get a lawyer licensed in Delaware, not Maryland) and they will likely handle it without you ever having to appear in court.

Speeding like that, in my opinion, is just as bad as drunk driving. As stated above, there is a reason the speed limit dropped!!! And you are only 18? Be lucky you even have a license. And I don't know the laws there, but you will be very lucky if you don't get it taken away. Here in the midwest, you can lose your license for 4 years for being a jackass. My boyfriend lost his for 7. Gets it back in 2009!! Been driving his dumb drag racing ass around for nearly 5 years, and have 2 more to go. He did get a work permit after the 5 year mark, but it cost him $1200.00 to get it. Now he can only drive Mon-Fri, in one car, and it has to be parked no later than 6 pm. If he gets caught on the weekend. Permit goes bye bye, and 2 more years gets added.

not probably definitely one in Delaware. If you get a MD lawyer he will charge you extra for having to travel outside of his jurisdiction. Also you'd want a Delaware lawyer who is familiar with the traffic violations, judges, and DA's. Also get a traffic lawyer not a criminal defense lawyer. 2 different type of lawyers. Also FON is right in that you may not have to appear in court.

It also seems as if you've upset the ticketing officer. Normally in these cases you'd stand a chance of having the ticket dismissed if the officer doesn't appear at your court hearing but considering you had him cursing at you I'd doubt he doesn't show up.

I live in Maryland, so

1) Yes, your provisional period will restart. Thats if they don't take away your license of course.

2) My friend was caught going 90 in a 55, so like you, it was 45 above the limit. He got 9 points and $720 in fines (for speeding and reckless driving).

However, since you were caught in a 35 zone and possibly a residential area, the fine and points may very possibly be more. Also, 9 points in Maryland WILL result in your license getting suspended. Since you're on a provisional, they might take it away rather than suspending it. Also, you will likely have to take a driver improvement class (maybe more than 1).

I'd take the bus to the court if I were you so you can get back home when you're done.

Oh and those little buildings on the sides of the road you were doing 80 on, those are houses and they have these things called kids that get killed by drivers like you.

Yes I have no sympathy. I hope you don't lose your license too long, but if you do you probably deserve it. Lawyering up might help you, but on the other hand a judge might go easier on you if you show up and tell him/her how stupid you were and you'll never do it again. Although if you pissed off the police officer it probably doesn't matter what you do in court because he will report what you did then.

Show up, take your licks and move on with life. Be grateful you didn't kill anybody. If you try to make an excuse in front of the judge he'll throw the book at you (which he might anyway.)

I just got back from seeing Knocked Up with a friend and it was like 1230 AM and I was thinking of this thread because I wanted to speed really bad. It was 35 through the frontage road to my house and there weren't any cars around. |

Of course it would have been really bad if I was going like 70 and someone didn't see me and pulled out in front of me. Anyway, hopefully you've learned your lesson on speeding. I know I learned my lesson when I got my ticket a few months ago. Now I drive about 5 over and that's it.

It's been about 9 years since I got my ticket. 84 in a 65. Officer knocked it down to 5 over for a smaller fine because I was honest and cool about the whole thing. Never showed up on my record.

I guess the lesson here is what you do after you get caught can make a big difference in what happens after.

OK - my helpful opinion (back on topic)

I'd pass on the lawyer because unless the officer did something wrong the lawyer can't do a whole lot for you anyway. It's pretty hard to mistake an 80 in a 35 so I don't think the officer did something wrong. The officer was mad at you. Did you provoke him, act mad and/or stupid when you got pulled over? If so then I definitely wouldn't bring up the officer's behavior to a judge because the officer will bring up your behavior.

And seriously, get a ride or take a bus/train/whatever to court because its possible you could lose you license on the spot. It would also be a good gesture that you are ready to accept the consequences for what you did which may (or may not) help your case.

Expect for your 18 months to start over again for sure. I live in MD and my sister had to restart her 18 months for doing 60 on a 40 as well as take a driver improvement class. 80 on a 35? you really dont have a case. Best thing to do is to act REMORSEFUL (which you dont really seem to be lol) and hope the judge is feeling merciful. But between the points, the signifciant rise in insurance, the fines, and the restarting of your 18 months you're in deep shizzle lol

Personally, I don't think you should even be on the road for doing that. You should get your licensed suspended until you've learned your lesson and never speed again. Cars aren't toys...they're actually extremely dangerous weapons.

i don't know, i guess i'm just a little less touchy about this than other people, I always drive 9 over the speed limit at least, because I won't get a ticket for that on kansas highways, 10 over is where it gets sent to my insurance, so it isn't worth the police to pull me over and write a ticket for 9 over... when my radar detector is working i drive 15-20 over in a 70... i've drove my vehicle 125 in a 65 one time, no big deal because it was on a road that I drive very often, there is a 3 mile stretch down in a valley that is as straight as can be, and you can see if there are other cars, I was only putting myself in danger, no one else...

Yours is a little different because it was in a residential area...

Gawd. I just got 2 citations today one for "following too close" and the other for 73 in a 65mph. The cop was such a dick. He laughed when I said I was gonna fight the ticket. Asshole. Then, after we take off, he goes and tailgates another guy going 80mph on the same street, then cuts off another guy roll

My friend got a reckless driving ticket for off roading (its hard to resist when your surrounded my desert) I think it was like 3-4 points and a $1,200 ticket. Good luck wink
