HIALEAH, Fla. -- A teenager with a brown belt in karate used a samurai sword to scare off a burglar who was after his PlayStation 3 video game console.

Last Friday afternoon, Damian Fernandez and his 15-year-old sister, Deanne Fernandez, were home alone at their northwest Miami-Dade County home while their parents were at work when they heard knocking on the front door. Moments later, two men were prying the front door unlocked, prompting Deanne to hide in her closet.

"I was so scared," she said.

As her brother slept in the next room, the burglars ransacked their parents' room, taking some jewelry before moving on to what they were really after -- a PlayStation 3.

According to a police report, one of the burglars kicked in Deanne's bedroom door. She said she could see his foot through the closet panels.

The burglar found the empty PlayStation 3 box and ran out of the room, but Damian was waiting for him.

"Once I saw him take off running back, I jumped off my (bunk) bed and I grabbed my sword … and I just waited for him," he said.

Damian said he lunged at him with his samurai sword, striking him in the chest.

"He freaked out," Damian said.

The burglar ran out of the house with Damian chasing him down the road. When police arrived, a K-9 officer located the burglar hiding behind a neighbor's palm tree. The second burglar got away.

Javier Cotera, 21, was arrested and released early the next morning on bond.

Local 10 attempted to contact Cotera at his Hialeah home, but his family said he wasn't there and that they didn't know anything about it.

Damian and Deanne's father, Delio Fernandez, said he is concerned Cotera is out of jail.

"If he would have had a gun, I could have lost one of my children," he said.

Cotera is scheduled to appear in court in two weeks to face three felony charges.[/quote39ed34b33d]

Though I have to wonder.... what would be the legal consequences if the kid had actually killed the robber. Ive heard stories of robbers suing homeonwers when they get hurt in the process of a robbery. |

I kinda doubt it was a real weapon-grade katana, because those range around a thousand dollars....

Still, if I was dumb enough to try and rob someone, I'd believe it.

I don't doubt that it was a real katana. This takes place in Miami-Dade..people there tend to have money (so I've heard). That's awesome though, he actually got to use his karate to defend himself, sword or not )

If he had killed the guy, I don't think anything would have happened. 2 reasons. 1 being self-defense, 2 being he's a minor who acted accordingly. Kudos to him all the way )

kinda reminds me of way back in the beginning... when my sn used to be chromekatana instead of chrome89k.... i felt the chrome katana would be a bit of a shitty sword seeing as though chrome would be a horrible material to create a sword from..

also... rouroni kenshin is awesome... i think the kid took lessons from him )

Does self-defense fly even if the robber doesn't threaten or attempt physical harm? How did they know the kids had the PS3? Deanne might have some explaining to do.

Yeah i dont think the court would see it that way either..... I guess it comes down to putting your worldly possessions above a humans life.

I believe the article stated that they told the girl to go hide? If so, that would be a clear indication that they did not threaten, attempt, nor intend, to cause physical harm.

You are wrong, in Florida you can shoot someone dead who trespasses onto your property or business.

Yeah that is a pretty recent law. And in most other states self defense is based off how threatened you are. Like if somebody breaks into your house you can hurt them but you can't kill them. I mean, it's weird to put an amount to it, but you arent' suppose to use more force than necessary.

But on a side note. . . my buddy lives down in florida and his one friend (who I met a few times) is this crazy dude. He was in the army in iraq for a while and has had a lot of weapons training and stuff. Well anyway some guy broke into his house with a gun and tried to rob him. This kid went all crazy on him broke his arm, and nose, took the gun from him and then demanded all the robbers money!!! So after the guy went fleeing for his life he ditched the gun and called the cops and counted the $50 he stole from the robber! lol

ive seen various knifes from these series make short work of flesh )

Gotta read up on maryland law concerning what happens if a robbers gets harmed in the process of theft though

knives are the worst weapon you can have for home protection. it requires close hand to hand combat which you dont want to do with an unknown intruder who could also be armed. get a gun if you really want protection. if you really want the knife or cant afford a gun right now, then fine.. just hope that the intruder never has a gun, or another knife.. because its nearly impossible not to get cut in a knife fight, especially with no training.
