yea this is a huge problem in our society people need to realize people the same age that are under age are having sex.

when i was little and watch talk shows with the underage girls that were pregnant and they use to say the guys can go to jail for rape i use to laugh it off till i saw this guy.

The laws governing man-badger love are outdated and irrelevant in todays society and something needs to be done about it.

I live in a state where bestiality wasn't outlawed until a man was killed because the horse was too big for him, if you know what i mean.

I'm just saying that the views of today are different than they were 100 years ago, and so laws should be changed to reflect the new society.

That didn't happen too long ago, I remember hearing that on the local news sometime before I left Washington...

Bernstein said she plans to look into filing a bond to have Wilson released while the appeal is pending.

Wilson has already served 27 months of a 10-year felony sentence for receiving oral sex from a 15-year-old girl when he was 17. Because of an archaic Georgia law on the books at the time of his trial, he could have been charged only with a misdemeanor if he and the girl had engaged in sexual intercourse. Subsequently, that law was changed; but Wilson remained in jail, which led to editorials in The New York Times and a letter from former president Jimmy Carter protesting the injustice of Wilson's original sentence.

Wilson's legal troubles began when he and a group of friends were charged with aggravated child molestation and rape following an alcohol- and marijuana-fueled New Year's Eve party. The jury, which repeatedly was shown a videotape the boys had made of the party, determined that no rape had occurred. But since Wilson admitted to receiving oral sex from someone under the age of 16, the charge was aggravated child molestation. The jury, under the existing law, was forced to convict him.

He went to jail in February 2005 and started his attempt to regain his freedom almost immediately.

His lawyers succeeded in having the law that put him in jail changed, but the Georgia state legislature declined to make that law retroactive. So the legal team tried again, working to have a new law passed, an effort that ultimately failed. That left Wilson's lawyers with a final Hail Mary They filed a writ of habeas corpus and asked a judge to void the sentence. On Monday, that happened.

The Superior Court of Monroe County in the State of Georgia reduced the charge to misdemeanor aggravated child molestation and ordered that Wilson's name not be placed on the sex-offender registry. Wilson was resentenced to 12 months and given credit for time served.

The finding of fact and conclusions of law in the order stated that "the fact that Genarlow Wilson has spent two years in prison for what is now classified as a misdemeanor, and without assistance from this Court, will spend eight more years in prison, is a grave miscarriage of justice. If any case fits into the definitive limits of a miscarriage of justice, surely this case does."[/quoteaf1e8d5432]

Attorney General is an elected position. He loses this, and he may not be re-elected. No excuse, but it's probably his prime motivation.

I don't know. Baker is a popular AG here -- I've always liked him myself -- and he's been re-elected several times I think (I'm not a native Georgian but I think he's been AG most if not all the time I've been here). I particularly like his position on an issue that is near to my heart. )

However public outcry over this is pretty severe, even here in GA. The GA legislature succeeded in changing the law after he was sentenced, but narrowly missed making it retroactive to this case.

So I honestly don't think Baker is doing it for election purposes, but maybe so. I have a feeling it's more of that emotionally-detached dedication to the word of law thing that a lot of prosecutors share. Hopefully it will be resolved quickly and they'll let the kid out. He's not entirely innocent here, but his sentence was unduly harsh and he's served far more than he should have for it.

The important thing to remember, under the laws of the time, is that underage (under the age of 16 in this case) sex cannot legally be "consensual" in the state of GA. It might be "volitional" or voluntary, but cannot be legally recognized as consensual, therefore volition is irrelevant. So if one party is a legal adult and the other is not, the punishment is severe -- as it should be in my opinion as a parent and old fuddy-duddy. However the state of GA has sent some mixed signals in the past concerning legal age of adulthood. Up until a couple or so years ago, 17 was an adult in the eyes of GA law, in the sense that parental rights and responsibility for the child terminated and the child could be treated as an adult (could leave home, could be arrested and tried as adult, etc.). However for other things, 18 was still legal age of adulthood. A couple or so years ago, as I understand it, the "legal" age was changed to 18 across the board as it should be (i.e. a 17yo who leaves home is legally a runaway and can be arrested and returned home to their parents). I'm betting this kid was caught before the law changed, so at the time he was an "adult" and the 15 year old was under the legal age of consent, even though in terms of age they were very close.

If he had been 21, his sentenced was deserved IMO. But at 17, I have a problem with it, especially with the lifelong stigma of being a sex offender.

Sometimes the laws we have are just NOT applicable to the situation, and when stuff like this happens, its sick.

Heh, check the date and the previous posts. ;)

That article is from June 11, the day his conviction was voided by the appeals court, however the AG blocked his release and is taking it to the Supreme Court to keep him in prison. It isn't over yet. He's still in prison and will remain so until the Supreme Court upholds the appeals judge, or until Baker changes his mind and relents.

The court ruled 4-3 that Genarlow Wilson's 10-year sentence was cruel and unusual punishment.

Wilson, 21, was convicted of aggravated child molestation following a 2003 New Year's Eve party at a Douglas County hotel room where he was videotaped having oral sex with a 15-year-old girl. He was 17 at the time.

Wilson was acquitted of raping another 17-year-old girl at the party.

The 1995 law Wilson violated was changed in 2006 to make oral sex between teens close in age a misdemeanor, similar to the law regarding teen sexual intercourse. But the state Supreme Court later upheld a lower court's ruling which said that the 2006 law could not be applied retroactively.

Chief Justice Leah Ward Sears wrote in the majority opinion that the changes in the law "represent a seismic shift in the legislature's view of the gravity of oral sex between two willing teenage participants."

Sears wrote that the severe punishment makes "no measurable contribution to acceptable goals of punishment" and that Wilson's crime did not rise to the "level of adults who prey on children."

The state Supreme Court had turned down Wilson's appeal of his conviction and sentence, but the justices agreed to hear the state's appeal of a Monroe County judge's decision to reduce Wilson's sentence to 12 months and free him. That judge had called the 10-year sentence a "grave miscarriage of justice."

Dissenting justices wrote that the state Legislature expressly stated that the 2006 change in the law was not intended to affect any crime prior to that date.

They said Wilson's sentence could not be cruel and unusual because the state Legislature decided that Wilson could not benefit from subsequent laws reducing the severity of the crime from a felony to a misdemeanor.

They called the decision an "unprecedented disregard for the General Assembly's constitutional authority."

A spokeswoman for Wilson's lawyer said his legal team received no advance notice of the decision.
