[quote7379b5b4bf]When Toysrus.com, Toys "R" Us, Inc.'s Internet retail business, sued Amazon.com to end their Internet partnership for breach of contract, it faced a key strategic decision Could it gamble on using its opponent's own Web site as a key trial witness? Toys "R" Us had to prove to the court that Amazon was violating its exclusivity rights under their contract. The only way to effectively do this was to show the court, live, what was happening in real time on Amazon.com.[/quote7379b5b4bf]

Unique and innovative strategy... this is a pretty significant milestone in e-law.

didn't apple music (the beatles) do a similar thing in their case against Apple computer?

this has been tried in the past, but never to the success discussed in the article.

also note, the article was written by the prosecution - which doesn't take away from the value of the caselaw and precedent.

fascinating and ballsy move...

wow, what a gamble...that paid off

do you guys think "Toys R Us" is better off with the contract voided?

I think it would hurt sales rather than help in the grand scheme of things

I think Toys 'R' Us shot themselves in the foot. Amazon is the biggest retailer online that most people know of. TRU just shoo-ed a bunch of potential customers that might not even think of going to toysrus.com. They should have just fought for 'exclusivity.'

Exclusivity is huge. When you completely monopolize a market like Amazon, that's a lot of business. When it's compromised with competitors products the whole marketing strategy is destroyed there. I think it was the right move.
