Problem with SBC HN060 Headphones from Philips

I recently sent these headphones in to Philips to be replaced, the right ear produced no sound no matter what I did. I received a brand new, updated version of the headphones.

Tonight, as I am chatting away, the right ear dies.

Different head phones, same problem.

Now, before I strangle someone with this/send them back, any remedies to this problem? Before you go and tell me

Noise canceling mode is not on, when on no sound from right ear.
Plugged in.
Volume was on the highest.
Brother says no sound and his hearing is better.
Plugged headphones into Nintendo DS and same problem was reached.

Now, I want to return these headphones...but I don't want a new set. Anyone know if Philips can reimburse me my 33 bucks?

I would say it's your headphone jack (based on my old Walkman experience), but you said that you also tried the headphones in another device with a headphone jack, correct?

I tried them with my computer and I tried them with my DS. Both times the right ear doesn't work.
