Hey there. Ok, I decided Time Factor wasn't for me, so I called and canceled. All was good until they tried to bill me w/out my permission, and I didn't have enough money in my paypal account.
So I called and they said my account was cancelled. Ok, maybe a mistake?
On June 24th they tried again to bill me. I called that day and someone called me back on the 25th....again they said it should have happened, and told me my account was cancelled.
On the 29th thay also tried again to bill me. Another denied..as I didnt have enough in my paypal account.
After all this I am getting pissed.
So I call and let them know, if it happens again, I will be filing a lawsuite.
Yesterday, July 4th, they billed me again...accept this time I had the $106 in my account. So now its gone. I called them last night and told them if I don't get this fixed within 12 hours they will be hearing from my attorney.
My questions are
1)Do I have a case?
2)Do you think they will try to remedy this by giving my money back?
3)Do you think I will actually have to go to court?(I am willing to but I'll will be going for ownership of their company...bastards)

You dont have a case unfortunately, their terms and conditions are shady, they state that WITHIN your 14 day evaluation they will ship out your full product for like 116 or some crazy shit. You can return that for a full refund minus the 16$ shipping and handling. I did that and just kind of had to suck it up on that one.

Oh and your stupid and or pathetic if you think that you can take ownership of a business by suing them for one fraudulent 106$ charge. Instead you should use a credit card which would allow you to dispute such charges.

Actually, I did cancel within the 14 days. Thus why I am so pissed.
And thanx for the stupid and pathetic comment. Accept one thing. If I end up going to court, I will fight until they are closed perminatley.

You're not closing anything. You probably could get that refund if you play it smart. Freebies are a dangerous game...
Edit - AOL once billed me after I had released their demons from my PC. I told them they billed me and gave me an over charge. They sent me some piece of paper that I gave to my bank to cover the charge. It wasn't a check or anything, just something saying, we fucked up, not him.

I just want my damned money back mostley. I was gonna buy some subwoofers today. I was $5 short a few days ago so I did a bank transfer...and finally had enough....blam....now I don't have shit in there...

Sold my car for 1200, got 400 from freebies there, 500 from my father, and the rest from 3 months of saving while working a part time min. wage job...lol
Thats actually the fund I have so far to buy myself a newer car.

You can send the TimeFactor back, but it has to be with tracked mail. I just got off of the phone with Customer Service. You'll be out probably $20. Better than being out $106.90!

I hate timefactor!! This is exactly what just happened to me. I evaluated the product, decided it was not for me and canceled on the 13th day (after I ordered). I received a cancellation confirmation and everything via email but two days later i was charged for $106 (luckly i did not overdraft). Since that happened June 29th They have not answered the two emails I have sent or returned my phone messege. shady as fuck

yup ends up being out about 21 bucks. and if you read what I said I told you that their terms state they will ship the full 116$ product or whatever WITHIN your 14 day trial. Its wordy and thats how they get you, they can send u the full package any time between 1 day and 14 days of signing up for the offer not after 14 days. You have no case and are obviously pathetic and immature like I said if you think you can shut a business down for one fraudulent charge for $106. You MIGHT, MIGHT be able to get a refund less shipping but nothing more since you did agree to the terms when you placed your order, thus waiving any right to have a lawsuit for such things, but whatever. You can spend thousands on a lawyer to get your 106 back, what do I know.

what if i canceled before the 13 days, but they billed me the $106 on the 15th day since I ordered, (thats not within the 14 days!).
Also, has anyone successfully talked with them through the phone? I have never gotten through, it just tells me to leave a message when no rep picks up. Of course they don't call back.

I'm stuck in this trap also, evidently, since I used a prepaid at the time, they cannot bill me but they will probably get the collections agency on me so I'm going to go ahead and pay it and then return the product that made my mom break out for a refund. Oh well, if this is the only thing I've ever run into with freebies over a year I guess it doesn't bother me.
Ghondi, no offense, but I wouldn't take it into court. I'd just return it and get a refund and then forget about it. You can learn from the situation and it would be a lot cheaper and quicker just to return it. When you signed up, you agreed to that contract. That's what matters in court and no matter how tricky it was worded, that's what it meant and you really can't get around that unless they will bow to you for even taking it to court (which I doubt they will). I'm not saying that you don't have the balls to take it to court or the money, I'm just saying I'd take the easier route and get the refund in a week or two. \

Well, Stamps does for sure since my friend recently told me that he got a letter from them (he used a prepaid). Of course I paid it since I introduced him into freebies and he was helping me out. He told me he cancelled but I guess he forgot so it was no biggie but I was kind of suprised. I would think Time Factor would especially since it's like $106? But I'm going to call them tomorrow during business hours and talk business. After all, I agreed to the terms of service by ordering so I'm going to pay and just avoid all the hassle as long as I get a refund.

I guess i'm talking about scam offers then, hate it when they charge you for something you didnt really order
what u could do, though, is report this to the BBB, the local newspaper for the company (where they reside), file a complaint at ripoffreport or whatever that site is, and lastly ALWAYS use a credit card that will back you in situations like this.

Thnx all. I did file a BBB report yesterday. I'm not paying to ship back their shitty product. I told them that on the phone...I havent gotten it yet but when I do, I'll get my RMA, or whatnot, and write return to sender..thus it will be shipped back to them at their expense.
Also, I am going to file with Consumer protection....and you guys are prolly right about court...you know how it is....think your the shit and won't stop till you win kinda attitude....when your pissed and shit...
