Ok, my mom was at the home goods store. And she was just looking at some frames, when a big metal pipe (or something like that ) just fell out of no where and hit her on the head. She's OK, but they had to call the ambulance (they carried her on a cot to the ambulance), but after it arrived, she told them it was ok, and she was able to leave. But im just wondering, could she sue them, edit and be compensated.

if you want to sue, go to the hospital AND a chiropractor ASAP...you never know what neck injuries she may have suffered that she doesn't feel now but will later.

If she's alright and doesn't feel defamed or embarrassed to the point of monetary loss, suing the store is an asshole move. Too many people sue others for stupid shit. My dad has been sued twice for the total of 18 million dollars, and has come up not guilty both times. Don't abuse the system, especially when you never know when the day comes you'll REALLY need it.

I'm a bit surprised by some of the earlier knee-jerk responses. Yes, I agree, frivolous litigation raises insurance premiums, and hurts serious personal injury cases, but head injuries are a separate matter altogether.

The problem, and I'm not trying to hex this in, is that head injuries that you can walk away from one day, can kill you a week later. Concussions and clots are things to consider, and if she has a reasonable excuse to have that checked out (Neurologist, MRI) then I think the store [if68d40ddcf]should[/if68d40ddcf] be responsible for those bills. If she's fine, then that's all, in my opinion. I don't know how frightened or disturbed she was by the incident, so I can't say she would be deserving of damages for mental anguish.

The very LEAST the store manager should do is offer a gift card, but it would likely come with a string attached, like signing a release, and you ONLY do that when the compensation is worth it, and you KNOW the injury isn't going to get worse later.

In general, you should ALWAYS notify a store manager when something like that happens, even if you didn't get hurt. If you don't, whoever stocked the shelf (was the pipe on a shelf?) could do it the same way again, and someone could get killed the next time.

However, what irks me is that he's already thinking of the kind of money he can suck out of the company...without knowing if his mother is actually seriously injured. If she is and the treatement/bills are very expesive, then I'd see the need to sue. And I'm sure the manager or supervisor was aware of what happened, as the medical team most likely talked to them for that same exact reason, just in case she did decide to press charges.

I mean, think about it. This happens, and he comes on the forum with, "Oh hey guys, my mom got hit in the head with a pipe, and she's fine, but I'm wondering how much money we can sue the company for...you know, just because."

That's what I read.

Back many years ago my mom was complianing about the shitty job this guy did on our floors. (it had airb bubbles and stuff) He threatend to sue us for somthing because we were complaining about the job. (I can't remember the word she used.....)

People will sue for anything. I saw on the news once they had a lady that was sueing a potatoe chip company because she got fat off of eating the chips even though they were labled "Low Fat" It was a very high lawsuit....somewere in the millions. (i don't think she won)
