STORRS -- Three University of Connecticut students who allegedly ejaculated onto a female student while she slept in a dorm room this fall have been charged with disorderly conduct and public indecency.

The three men are to appear in Superior Court in Rockville later this month to answer the charges, which came to light recently when The Courant received a tip.

The case has raised concerns about why the state's sex assault statutes could not be applied and has brought pledges from top law enforcement authorities to change the law.

Police and prosecutors said they could not press sexual assault charges because the men did not touch the woman - an outcome that outraged state Victim Advocate James Papillo.

"It is demeaning and extremely embarrassing and every bit as violating as a sexual assault," Papillo said. "It ought to be treated as a sexual assault case, and the penalty ought to be harsh in a case like this. Disorderly just doesn't cut it. This is in a different league altogether.

"Unfortunately, it may be just the way the law is written that there is a loophole here."

State prosecutors acknowledged that the charges in a case like this should be more serious, but contended that they were constrained by the legal definition of sexual assault - which requires "contact" between the accused and victim.

Chief State's Attorney Christopher Morano said Thursday he would pursue changes in the law, and state Rep. Michael Lawlor, D-East Haven, who is co-chairman of the judiciary committee, said he would consider them.

"There should be a crime that addresses the degradation of this young lady, and we need to come up with a statute to address this type of abhorrent behavior in the future," Morano said.

Two of the students, Jared Skvirsky, 20, of Brookline, Mass., and Martin V. Piscottano, 19, of 72 Root Road, Somers, are both seeking accelerated rehabilitation. The third, Zak A. Brohinsky, 19, of 299 Old Farms Road, Simsbury, is still in pretrial negotiations. Brohinsky is the son of university relations director Scott Brohinsky.

Due to privacy laws, UConn officials would not comment on disciplinary action taken against the students, including whether they were expelled. But officials said they are no longer students at UConn.

According to arrest warrant affidavits, the incident began in the early morning hours of Sept. 24 in Skvirsky's dorm room in Watson Hall, where he and the female student went after they met at a party at the Carriage House Apartments off campus.

The two began kissing, and then the woman stopped, deciding she didn't like it. She decided to sleep in his room because it was late and she didn't feel safe walking home alone and fell asleep on a futon in the room. Skvirsky fell asleep on his bed. Both had been drinking, but said they were not drunk, an affidavit said.

A short while later, Brohinsky, Skvirsky's roommate, came into the room with his friend, Piscottano. They tried to wake the woman so Piscottano could sleep on the futon, but she would not get up, according to an affidavit.

The three men watched a porn video on a computer and then took turns ejaculating on the woman's face and body, an affidavit said. The woman said that when she woke up, she felt something on her and thought she had drooled on herself, an affidavit said.

After Brohinsky and Piscottano left the room, the woman asked Skvirsky what was on her face. He said he didn't know, according to an affidavit. The woman returned to her dorm room and washed her face, but was concerned about the substance.

The next day, Skvirsky sent an instant message to the woman stating, among other things, that "they were really drunk" and ejaculated on her, an affidavit said.

According to an affidavit, Brohinsky and Piscottano got together, and Piscottano typed a story they all planned on memorizing and repeating to police in case the woman called police. Brohinsky also e-mailed the made-up story to the woman, hoping that she would buy it and not call the police, according to an affidavit.

The woman went to police on Sept. 27 to press charges.

Piscottano's lawyer, I. David Marder, declined to comment on the case. Lawyers for the two other suspects could not be reached for comment.

Scott Brohinsky declined to comment on the case.

UConn police, who made the arrests, said they initially believed the case qualified as a sexual assault, but after consulting prosecutors, realized it did not apply because of the nature of the sexual contact, UConn police Maj. Ronald Blicher said.

"It doesn't fit the definition of sexual assault unfortunately. Otherwise, they would have been charged with sexual assault," said the prosecutor in the case, Assistant State's Attorney Elizabeth Leaming. "There would have had to be some kind of contact between the intimate parts of the body involved. Semen is not defined as an intimate part."

Leaming said this type of crime has come up repeatedly recently, with suspects ejaculating onto victims.

"It's a frustration that there is no ability to charge a sex offense for the kind of conduct alleged," Leaming said Thursday.

Morano said he is scheduled to meet with the legislature's judicial committee next week and plans to raise the issue of passing a new law to cover this type of crime during this session.

Lawlor, the co-chairman of that committee, said Thursday he would look into the issue. "If they feel that it is not clear enough, we could clarify that that is sexual contact."

Brohinsky is scheduled to appear in court Feb. 15, and Skvirsky and Piscottano are to appear Feb. 28.
