There wont be a "brag brag" post from me.

I received the parcel in which the nano was suppose to be in. I was so excited I opened it up right in front of the mail lady. When I opened it, there was nothing inside the box but two peices of styrofoam. They forgot to put the ipod nano in the box. I dont think it was stolen because the box was not tampered with. I have a witness (the mail lady). And also, the weight of the package on the packing slip. I never received the nano. Im very upset.

I can explain that. I talk to the mail lady quite a bit. I'm always walking home and I run into her. The day before I was expecting the package, I asked her if she could sign for me because I might not be home. She said she would and she did, but when I was walking home I ran into her and he gave me the package right there and it already had the note on it. Yeah he is usually helpful but I have been trying to ask him for help and if he would look into my account because Freepay greyed two of my refs for no reason. I thought he was going to help and look into it to speed things along but he just says have them keep talking to the CSR's. All they do is send automated responses and close the tickets without proof or a legitimate reason. If we get this worked out then I will be a believer in Jake and Freepay's complete competence but not right now.

I still am a loyal customer. And I did have an empty box. Im not going to lie about something like that. But if this doesn't get resolved Im taking it into furthur action. Im not the kinda person that is going to let this slide. I did my part, and freepay should do there's, properly. Wether it was a dis-honest employee who decided to keep the ipod for himself instead of putting in the box, or if it they just forgot to, they need to fix it. actually, no, it's not. I worked in a warehouse doing shipping and receiving for a while. If freepay's fulfillment people do their stuff the way we did ours, a package is weighed once, that info is put into the computer, and all subsequent packing labels have that weight pre-printed on there.

Oh, and as a personal opinion... I keep hearing/seeing the phrase, "I wouldn't lie about something like this." this is exactly the sort of thing people lie about. Why not? Publically throw some crap around and get another $250 ipod. sounds easy.

Also, if Canadian post is like here in the US, it's illegal for your postwoman to sign for you.

I have to side with freepay on this one. I don't know about anyone else, but if I ever get an empty package from freepay, I'll know it's an honest mistake, and I'll go directly the freepay to get it resolved. I could guess as to why one would come here, first, but that involves some assumptions that I don't think I can make.

no, you just made that up. i was walking home and the mail lady saw me, and asked me if I wanted my package now. I said yes, and she gave it to me, (that note was already on it), and I sitll signed for it because I was there. So she NEVER signed for me. I did. I opened it up in front of her, and there was nothing inside. She went way out of her way to find out what happened. or it could be that little extra thing u get when u live in canada mail ladies coming inside for a bit.

the facts i see is

box was empty, peices of styrofoam in it, which i have never seen before, i got my stuff from freepay with a big peice of bubble wrap around it.

the only way someone will know if this is legit or not is

if gratis calls up they provider i dont remebr who tehy use lets just say ecost and provides ecost with the package idenitification # which bspence would provide. from this they could get the shipping infromation about it. if he was making this whole thing up the tracking info wouldnt get any results. also ecost could would also be able to tell gratis what kind of packing they used for it, if they say they used bubble wrap than u know this is a fraud.

there are a lot of possibilites on what could of happened

one unlikely but possible situation is this
he received his ipod that day he takes everything out of the box and replaces it with 2 syrofoam bricks and than drops it off at the postoffice and it gets sent to him and than his part of the story kicks in

im not saying he got one or he didnt im just givng possiblilties

He says that, but there is a photo of the box unopened indoors (is everyone missing this?). That means he couldn't have opened it outside in front of her. He had to have gotten the package from her on his way back home (as he says - no one said he picked it up from the Post Office), and she had to have followed him home (since she was with him when he opened it) and into his house for the photo session.

No manipulation here, just going by his photos and his story, which makes for a very friendly mailwoman with a lot of time on her hands. And if he wanted good proof, why not take the picture of the mailwoman with the open box? She was supposed to be there the whole time the photos were being taken.

Secondly, I did not tell full detials of what went on, but I ran inisde my house to open it, then I ran outside with the empty box to show the mail lady. From there, she took it to the post office to see what she could do. She came back several times. And I DID sign it. She NEVER signed it. Even though thats what it said on the box, she never did. Cause she ran into my on my street and gave it to me, the note was already on it because if I wasnt home she was going to sign it. But I met her so there goes that theory. I'm not trying to get an "extra" free ipod out of this. Im seriously pissed off and if it doesnt get resolved, im taking it to small claims court. Im not letting anyone get away with this. Weather you guys beleive me or not, it doesnt matter. My parents were there and know I have been working on getting the free ipod nano for months. Even if I don't win the small claims court case, I will still feel good that I fought as much as I could. Now why would I go through all that trouble to get an "extra" ipod in my hands.

I took it with my camera phone which took two seconds. Opened the box, and there it was empty, so I ran outside and showed the mail lady. Yes, I could have taken it out, but why would I go to friggin small claims court over this if I was lieing! I wouldnt! It would cost too much to even bother. But if it doesn't get fixed, im going to have to do something about it because it isnt right.

I don't think the above relates to your situation.... Your Ipod was "lost" but it wasn't really lost during shipping; you liDIDli get a package.

I mean, if they were obligated to send you your gift just for completing the offers, then I'm sure there would be a lot of people who have had their accounts put on-hold suing for their freebies.

Well I don't know how Canadian law works but I actually talked to one of my pre-law professors about this cuz he used to be on the state supreme court for indiana and before that he was the indianapolis city judge. but anyways, he said that you wouldn't win the case. he laughed a little and said that there have been sooo many times where people lied just like you (i'm not saying u are lying but similar situations) and claimed about not getting an item. The defense team for Freepay would just simply use precedence, which means that they can mention what other judges and courts said about a similar incident. Since like 99% of the time it was people like you, the accuser, was the one that was lying, you are fawked. there was a case like this just this year about 3 weeks ago but with like some kind of watch promotion for another company. the guy claimed there was no watch inside, took it to court, got booted out faster than u can say "canada sucks". Another thing, if you opened it inside your house, you're doomed. If you actually opened it and the mail lady saw you open it and there was nothing inside, then you have a valid case. Other than that, no matter even if you were inside and your parents saw, it won't matter....there is no actual proof that you are NOT hiding that shit. and in this case, if u are trying to get freepay the guilty sentence, u are going to have to prove that they did it.... without ANYreasonable doubt. the fact that u opened your box inside your house without a neutral party observing, you are once again, FAWKED. he said u MIGHT have a slightly more advantageous case with the actual shipping company instead of freepay but once again, you can't prove that you didn't take the item and hide it or something. and i'm sure what they would do is just be like u are the only person that has ever complained of something like this....and once again....stats are against you...therefore you are FAWKED....

thanks. but i wish it was that i never lost anything out of this. but now im down $400 CND. You see, (if u read a differnt topic i wrote earlier), I sold that nano i was suppose to get right after I got the confirmation that it has been sent via prority courier. But the person's account I sold it to was stolen and I got a chargeback on my paypal account for $400. But I never got an ipod so its kinda a good thing cause I wouldnt have one for the person I sold it to anyways because of the freepay mistake. But now im down $400 and have no way to repay it other than work for two weeks. so this really bums be out cause i got screwed over twice in the same week. not fun.
