They should have put more time into the beta testing.

All they have to do is replace it and the guy has no case. I hear its only 3% defective. Thats pretty freaking good for a new product rollout...

it's free money for his lawyer if he doesn't win the case... unless he got one of the shady ones who dont' make you pay if you lose

Why would you buy something from a company who can't keep an operating system up and stable more than a day? When they've been working on it for 20+ years?

Companies that distribute linux have made a stable OS in a short amount of time. Ubuntu, such. Even though a lot of the code was already there, they still had to configure it. As the code was there for XP from 2000, 98, 95, 3.1, DOS?

Actually ... for MS, it'll probably be cheaper for them to just do a settlement outside of court ...

the lawyer signed on, if he thinks they have a shot at winning, for a percentage of the winnings. Otherwise it's by hour, but that's a relatively rare thing to do in these type of cases, simply because you get more money going for a percentage. But that depends on how confident he is in the case.

So, MS will probably settle due to the costs involved with going to a trial, the guranteed 'victory' for them, not to mention the negative publicity they'd get.

For MS to settle all they have to do is give him a new 360. You can't sue Apple for $10,000 because your Nano is scratched if they offer to give you a new one...
