PostalService has gone red on both of his greens on YourPS34Free.com. He told me that he had a friend that was willing to go green on my site, and "both of them" did green within a matter of hours. However, I found out today that PostalService has frauded TraInn and most likely has scammed me. Has anybody else had this user go red?

Yes, Twon has this user red on their 3604free site...looks like she is going to be owing a lot people money.

Yes that was a remarkably ballsy scam. Even had the moxy to call out Findme when he balked on paying. He should have just run off at that point.

Anyway.

He/she did desktopcomputers4free under the email= email=postalservice2020@yahoo.compostalservice2020@yahoo.com email=postalservice2020@yahoo.compostalservice2020@yahoo.com/email. He/she is still green, but I have filed a support ticket to trainn to investigate.

It would be helpful if everyone posted what sites were done and under what emails.

No...paypal has so many clauses that make it very hard to get your money back. The only chance is maybe not banning them and hope they come back to post...because I think the paypal account is her friends account not hers...as the friend was the one informing her to scam...so we have to find out her friend is. email==batmanvision2020@yahoo.combatmanvision2020@yahoo.com=batmanvision2020@yahoo.combatmanvision2020@yahoo.com/email is the email address of the friend I guess.

PayPal policy is to deny all claims for intangible transactions, i.e those involving services or other than physical items. About the only times I've heard of PayPal approving claims against referral scammers, was when the parties falsely claimed there was some "item" being sold. Which could itself be construed as a violation of PayPal terms and considered fraud, so I don't recommend you do that. You know, the irony and all...

That said, I always encourage people to report scammers to PayPal regardless. Even knowing that you'll get denied, I have to believe that PayPal logs records of all disputes, even those that are denied. Let somebody accumulate several disputes against them for the same thing, and odds are PayPal will take note of that person and eventually exercise its option to terminate that persons' account. Or to freeze that person's funds at the slightest indication of shadiness during their next eBay transaction. Whatever. So follow through with the complaint regardless, just don't expect any money back.

I guess that's a good philosophy. If you don't expect any money back and you get it, you'll be happy. But if you are expecting to get money back and you don't, you'll be sad. It's hard to do that though when we know we've been scammed. (

even if they froze her account she would still win because she probably transferred the money to another paypal account or sent it to an unverified bank account ( takes 2 days to change to the status "completed" and by then paypal can't reverse it )

What about this?

"A claim has been filed against this transaction. The seller's deadline for responding to this claim is Apr. 1, 2007. If the seller does not respond by the deadline, the claim will be decided in your favor. You may cancel this case at any time by clicking "Cancel" below."

nah, they will try to get it back if the person has it in their accounts. if not then they will tell you " sorry the person doesn't have any money in their account and they have been notified to place X amount of dollars in their paypal account to kill the limitation."

I give the person props on pulling this off. She now has 30 tr. A damn good plan i would say. starting off posting a thread about how i won't pay her and ending up with a closed paypal with a lot of money located on another paypal account.

GOOD IDEA! I would have NO problem with that. Something needs to be done as it (the scamming) seems to be getting REALLY outta hand lately.

The problem is that with sites like Project PayDay, they are basically telling people that they can get "instant" cash doing site offers. So they come here thinking WHY should they wait for approval? They think they are being scammed by not paying them immediately after green. roll

So, a rule like above would probably help some. If there was such a rule, then anyone who doesn't abide be it has no reason to complain on this forum.

i thought that this was a good letter that could be referenced for when writing to paypal it was on the a4f thread that i read about this guy...

I commenced chargeback proceedings against him today.

His arguement is that the referral is an "intangible" or "virtual" item and tries to tell you that your transaction cannot be disputed. I asked an attorney fiend of mine and he suggests that the referrals are tangible since they are worth goods or money when enough are collected.

In my case his referral to me for thepaidclub.com was one of four that I need for $100. Thus the referral is worth $25 which is a tangible amount.

I hope that this helps you guys. When disputing a claim like this you have to point out that the referral is a "service" and has tangible value or else paypal is not going to give your claim a second look.

This is the letter I sent to paypal if anyone wants to reference it for verbage

"This seller is paid by users such as myself to complete referrals on websites. These referrals are collected and after so many are gained they are redeemed for items or in this case cash.

I paid this seller to provide a referral for me on thepaidclub.com. Initally his referral was approved and he was paid for his services. After verification, thepaidclub.com has found that this seller broke the rules of the site by using multiple accounts to provide referral. This is not allowed and considered fraud. As a result of the verification process and discovered dishonesty, the referral that this seller provided was revoked from my account leaving me with no benefit given for the money I paid him.

It should be noted that the website that hosts the forum that allowed the seller and I to enter into this agreement (anything4free.com) has banned him from the site for fraudulent and dishonest practices as well.

The seller will argue that the transaction is not open to dispute because the item involved is intangible, this is not true. In this particular case that referal was worth $25.00 to me as I can redeem four referrals for $100.00 in cash.

I ask that the transaction be reversed for services not rendered.

Thank you for your attention to this matter."

He started with 0 TR only a few days ago, though. ?

I guess that a clause that says, "Newbies are only allowed to trade with a user of 10+ TR" would help too, but it would be a bit restrictive. It could be used to help against newbies that help other newbies pass the 4 TR mark.

Well ... Ya gotta start somewhere. ALOT of the problems seem to come from the newer under TR4 traders. I realize that one could be a TR300 and still do a scam or two, but since the large influx of new traders from sites such as Project Payday, this type of rule just might settle the newcomers down a bit.

But in this case it seems as if a PayPal dispute is definitely warranted.

Good Luck!

I'm curious as to why PayPal is inconsistent with handling disputes. If you're paying for something via PayPal, then it obviously has "value" otherwise money wouldn't be changing hands. However that doesn't make it a tangible item.

[quote79ad4f6236="PayPal Help"] What goods and services are not covered under the Buyer Complaint Policy?

PayPal is committed to ensuring that all transactions are safe and secure. One way we do this is by providing specific terms and conditions that all members must comply with. [b79ad4f6236]PayPal's Buyer Complaint Policy does not apply to virtual or intangible products (like subscriptions and computer programs), services, cash advances, and all non-tangible, non-physical goods.[/b79ad4f6236]

To learn more about PayPal's investigation process and policies, review the Buyer Complaint Process at https//www.paypal.com/bcp.[/quote79ad4f6236]

That last link there takes you to PayPal's User Agreement, where it states[=https//www.paypal.com/bcp#pbp-policy]where it states

[quote79ad4f6236="PayPal's User Agreement"]13. Disputes between Buyers and Sellers - Buyer Protection Programs.

13.1 Buyer Protection Programs. If you buy an item using PayPal and either do not receive the item or receive an item that you believe is Significantly Not as Described by the seller, we encourage you to open a Dispute with the seller in our Resolution Center. By doing so, you will initiate our Online Dispute Resolution Process—a step-by-step system designed to facilitate communication between you and the seller in order to get resolution of the issue. If your dialogue with the seller fails to produce a satisfactory result, you can then escalate the Dispute into a Claim that we will evaluate for reimbursement under one of the following programs
a. PayPal Buyer Complaint Policy - Our best efforts program to reimburse Users for losses only to the extent we are able to recover the funds from sellers.
b. PayPal Buyer Protection Policy - Our program to reimburse Users for losses for up to (i) $2,000.00 USD (Top Tier Converage Amount) for eligible items purchased on eBay and (ii) up to $200.00 USD (Basic Tier Coverage Amount) for all other eligible items purchased on eBay. Please see section 13.9 to determine whether Top Tier Coverage Amount or Basic Tier Coverage Amount applies.
c. Buyer Protection for eBay Express - Our program to reimburse Users for the full amount of losses for items purchased on eBay Express.
d. Extended Buyer Protection with PayPal Credit - Our program to reimburse Users for the full amount of losses for items purchased using the PayPal Plus Credit Card or PayPal Buyer Credit.

[b79ad4f6236]These programs only cover payments for tangible, physical goods. All other payments, such as payments for intangibles, services, airline flight tickets, or licenses and other access to digital content are not covered by any Buyer Protection Program that we offer (but may be covered by Chargeback rights).[/b79ad4f6236][/quote79ad4f6236]

The item being traded here (a referral) is very much NOT a physical, shippable, tangible item. If an airplane ticket or a software license is specifically not covered, then I don't know how anyone could argue that a freebie referral itself is tangible. People dispute ref payments all the time, and they rarely if ever get reimbursed, that's why I'm surprised here.

That said, file those complaints anyway, and if you get a PayPal rep processing your claim who either isn't paying attention or who feels sorry for you, then maybe you get luck and get your money back. Worst case is they say no, but most likely still log the complaint against the person.

Regarding why PostalService isn't banned yet -- folks let the staff here do their jobs, okay? ;) If we banned every would-be scammer the second somebody went red, then a lot of trades and payments would have never been resolved. Many times people have had a good excuse or some problem beyond their control, or just frankly screwed up but want to make things right. You guys haven't given Postal much of a chance to respond yet. Give it some time and if he/she doesn't step up, we'll take care of it. In the meantime I'll restrict his/her access to the Trade Module and set their TR to -1 until we know whether he's going to make good or not.

I've sent a dispute to paypal. I've got faith. How can they deny this claim?

"Yes, I ordered a referral and instead got the shaft. I don't like the shaft. I wanted the referral. It was what I ordered, and might I say, far less painful than the shaft I received. Had I have known that the I was going to get the shaft, I never would have ordered this service.

Specifics I paid 27 US dollars for a referral which, in reality, was 1/5 of the amount of the referrals I needed to recieve a payment from a website. The seller agreed to do it and in order to do so, the seller had to agree to abide by the terms and conditions set forth in the website. He did not abide by them, and his account was locked, which in turn, voided the referral. The seller has been contacted through normal email, but I am filing a dispute because the service that was payed for was not delivered.

Once again. The breakdown.

Ordered Painless Referral

Received Painful Shaft"

As long as the paypal agent reviewing my claim has a sense of humor (and preferrably a blood alcohol level of at least .15), I'm as good as paid!!!!!

Ah, who am I kidding. It's over.

then if paypal closes your account by doing that then get a lawyer ( that you have in your family ). I am sure paypal wouldn't want to get a high level lawyer and waste big money over something that is just 25 dollars lol. thats liifli they close/limit your account.

note this is only for those people who got scammed in the hundreds or so. file a dispute with paypal and wait for some days for the results then hit the credit card company.

Yeah going to the credit card company is a bad idea unless used as a last resort.

An intelligent lawyer would not bother findme. All it takes is one read through Paypal's terms to know that you'd have NO legal standing in that situation of paypal terminates your account.

Paypal does not adhere to guidelines. They are not a bank. Basically, they can do whatever the flilili they want and you agree on it upon signing up.

Paypal's legal team would laugh if a lawyer tried to dispute that. It's all in the terms as clear as day. If they want to cancel your account because you put your CC company against them, they sure as hell can.

Responding to this post from a few days ago. I was scammed by fittnessgirl34 yesterday, who seems to be the "friend" involved here with postalservice. I knew i was scammed as soon as i was complete...i normaly cover myself through pm's saying when i have the right to pay on approval instead of on green. Well i was in and out yesterday and was in a hurry and didn't cover myself...and got burned. Anyways, i sent a email= to email=fittnessgirl34@yahoo.comfittnessgirl34@yahoo.com to email=fittnessgirl34@yahoo.comfittnessgirl34@yahoo.com/email telling them that they were a liar and what i thought of them to make me feel better. They used the name sarah bany in their unverified paypal account (wich is where i failed to cover myself as i normally do). However they responded to my email and the name that came back was john cooper. As soon as i saw that i thought of the Jonathon Cooper who was a big scammer on A4F that was referanced here. Judging by the email I got from Jon's (so called) father, this is not JON at all but someone using his name for PayPal. Check the email I got from him out in the post on fitnessfreak. If this is the case, then PayPal should refund us as this is someone who frauded PayPal with incorrect account information. I bet his bank account works though.

We could always call the Glendale, AZ PD and have them look into this cyber-scam. It probably would not get us anywhere legally but might put some poop in their undies when a cop shows up at the door.

If this is Jonathon Cooper (and I suspect it is) his daddy refunded all the money last time when someone figured out where they lived and how to get ahold of them.

Any thoughts?

I'm fortunately not involved here, but if you have a verified address then somebody local could take their individual claim to small claims court, pay $50 or so to file it and that should be a pretty easy victory. You have to file and show up at their court location so it won't work for most, but somebody might get lucky.

Small claims takes no lawyers, the two parties show up and show their stuff directly to the judge. The PM record / trade module record and statements from some others would probably suffice.

It might seem kind of petty for $20, but it would do 2 things
1 Teach the person a lesson and hopefully make it stop
2 Put a judgment on their credit for the next 7-10 years making it more difficult for them to get credit cards, etc when they want to.
Also if you are the victor the other party would have to pay the $50 filing fee as well.

If somebody does this to me and they live within a 5-6 hour drive you can bet I'll be filing it in court. But hopefully I'll stay lucky and not have this happen.

Sorry to post here again, but if enough of you care you could also get together and hire a collection agency. Explain the situation to them and the debt, how it arised and why it's a legal debt. From a prior job I know that typically collection agencies may work for 50% or something like that. It seems that there are enough of you to turn this into a $300 collection.

This would have nothing to do with paypal and their policies, it would just be dealing with the agreements you had with him/her. A user you trust would get whatever fund from the collection agency (if any) then divy it ou to the others.

If you were feeling particularly nasty you could get his/her IP and send a letter to their ISP telling them they are using their internet account to scam people. With enough letters like this they may have their internet service canceled on them.

Where would you get an IP address on FiPG? Would we have to ask the admins for it?[/quotecd0bc5883e]

Dude, you're still here?

I'm surprised you've not been banned yet, and I can't understand why I'm not about to, but it has something to do with curiosity, holes, digging and track number 9 on Arcade Fire's first album Funeral.

[quotec76daa4ea3="sandra habina"]Congrats - did it take 5 months?[/quotec76daa4ea3]

Yep. IIRC way back when this had been resolved in my favor but paypal could not recover the funds. I can only speculate that paypal found another account that this scammer was using and recovered it that way.
