Fictitious referral?

I'm dealing with a trader who has a bad reputation generally (wish I'd searched this forum before agreeing to the trade). It's been more than 5 weeks since his "friend" signed up as a referral for me. No green. (Took him four days to even go yellow - I had to threaten.)

Is there any way to find out whether this friend even exists? Couldn't a scammer at least go yellow by signing up pretty much any e-mail address? The circumstances of our trade (I'll spare the details unless you want them) make me suspicious.

He - or someone - signed up and is yellow. But they've been yellow for 5 weeks. And I am probably getting scammmmmed.
