I am not a citizen/permanent resident, but I am here to study... am I eligible for the scheme? The TaC just say that I should be living in the US and 18 or older...

The terms and conditions simply say you must be a resident. Since you are currently residing here I'm don't see why you couldn't get one. I think they just need a U.S. shipping address. I don't think they seek proof of permanent residency.
However, I'm only speculating since I don't have an iPod yet. (
