I just talked to a couple attorney friends of mine who have been looking over the free ipods terms of use agreement and all that crap....

Apprently there were a few things that weren't changed in the terms when the switch from ipod to hpod were made available, Gratis could very well be in some deep deep shit over this if people raise enough stink. From what they've told me, there are a few other agencies watching gratis very carefully to see if they make some mcuh needed changes in the terms agreement soon, or they're ready to attack.

I hope we're still getting free ipods.......

I don't see anything in the terms that has to do with the brand or anything....also I don't see why they would get in trouble, their branding is Free "iPods".......not Free "Apple iPods"

And one more thing... don't you think Gratis has their own lawyers who wrote those terms of service?

Plus, why would the switch from iPod to hPod be an issue? They didn't do it automatically - people had to consent by pressing a button and switching....

...not to mention the fact that Gratis clearly states in the TOS of all their free stuff sites that there is NO guarantee any item will be shipped to the customer for free. It is possible but if it doesn't the TOS covers that and they can't get sued.

I'm chalking this one up to I-think-I'm-so-smart bullshit on the part of your "attorney friends".

There are not "other agencies" conspiring against gratis. Even if they were, your "attorney buddies" would not know about it because that would eliminate the element of surprise from the lawsuit, which is really important. Besides, if they knew about it, it wouldn't be a conspiracy then, would it?

Yeah, i have a computer, but still no ipod.
people can afford an extra $30-40 a month for broadband, but not everyone has an extra $300 laying around to drop on an mp3 player.

If there were any truth to this, it would have to be something in the warranty of the HP iPod, that is different than the Apple one, and somehow conflicts with Gratis' TOS.

Send me a free HP iPod, and I'll check it out for you. ;)
